Consumer Terms & Conditions of NordPass’s Gift with Purchase Promotion

These are the Terms and Conditions of Nord’s Gift with Purchase Promotion (“Promotion”). By participating in this Promotion, you agree to these Terms and Conditions, which are a binding contract between you and nordvpn S.A., PH F&F TOWER, 50th Street & 56th Street, Suite #32-D, Floor 32, Panama City, Republic of Panama (“Nord”), so please read them carefully before entering.
1. Eligibility.
This Promotion is open to all individual users of NordPass Services (as defined in Section 1.1 of the General Terms of Service), provided they meet the specified eligibility criteria outlined below:
Participants must be aged eighteen (18) years old or over (at the time of purchase);
Participants must purchase a one (1) or two (2) year plan subscription of NordPass Services Premium plan that is reflected on the NordPass website (“Plan”) during the Promotion Period (as defined below in Section 2) and through the NordPass website; and
Participants must maintain the purchased Plan subscription for more than thirty (30) days (i.e., not request a refund for the purchased Plan as per “Money Back Guarantee” terms outlined in Section 6.2 “Refund” of the General Terms of Service).
For the purposes of these Terms and Conditions, individual(s) who meet the above criteria is(are) referred to as “Participant” or “Participants”.
Promotion is not valid with any other Nord’s offers/promotions. Employees of Nord, its subsidiaries, affiliates, and parent companies, or anyone associated with the administration of this Promotion are not eligible to participate.
Purchase of the Plan is necessary. No entry fees apply to be eligible for the Promotion.
2. Promotion period.
The Promotion starts on 16 October 2024 at 10:00 Central European Time (“CET”) and ends on 8 January 2025 at 10:00 CET (“Promotion Period”). The timekeeping device used by Nord is the official clock of the Promotion.
3. Gift.
Upon successful purchase of the Plan within the Promotion Period, each verified and confirmed Participant (who meets the following eligibility criteria as specifically defined herein) will receive a 3-month additional Premium Plan subscription of NordPass Services (“Gift”).
The Participant may not exchange the Gift for cash, other items, or services. Nord does not assume responsibility for lost or stolen Gifts for reasons beyond the Nord's fault, and replacements will not be provided. The Gift is as stated and nothing else is included.
4. How to Enter and Gift Delivery
During the Promotion Period, all Participants meeting the criteria set forth above in Section 1 will be eligible to receive the Gift.
In any case, the Gift will be delivered after the expiration of the Money Back Guarantee period (as defined and explained in Section 6.2 of the General Terms of Service). For the avoidance of doubt, provided that the 30-day period of the Money Back Guarantee period has expired without the subscription being canceled, all eligible Participants will automatically receive 3-month additional Plan subscription of NordPass Services by Nord adding it to the Participant’s purchased Plan, and details about it will also be displayed in the Participant’s Nord account.
No more than one (1) Gift per Participant: anyone attempting to enter more than once (including, without limitation through multiple accounts or email addresses) will be disqualified.
5. Privacy.
Nord will retain the information pertaining to the NordPass Services, as set out in Nord’s Privacy Policy. No additional information concerning any Participant will be collected, except for data related to participation in the Promotion and, if applicable, the received Gift, which will be exclusively processed by Nord for this specific purpose. This personal data will be processed for the purposes of organizing and coordinating the Promotion, ensuring compliance with these Terms and Conditions, preventing abuse, and delivering the Gift. It will be retained for the duration of the Promotion and will be deleted no later than one (1) year thereafter. Participants reserve the right to object to receiving the Gift at any time by contacting our support team at [email protected].
6. Release and Limitation of Liability.
If the Promotion is not capable of running as planned for reasons outside control of Nord (including but not limited to tampering, unauthorized intervention, fraud, or any other causes beyond the control of Nord that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this promotion), Nord reserves the right (subject to any written directions given under applicable law) to disallow any reward claims at its sole discretion or to cancel, terminate, modify or suspend the Promotion.
To the extent permitted under applicable law, Nord assumes no responsibility for damages, losses or injuries that result from acceptance of the Gift or participation in this Promotion.
7. Additional Terms.
Each individual participating in the Promotion was, is, and shall be bound by the General Terms of Service for the duration of the use of and access to NordPass Services.
Nord may, in its sole discretion, disqualify any individual found to be: (i) tampering with the entry process or the operation of the Promotion or any of Nord’s websites; (ii) acting in violation of these Terms and Conditions; or (iii) acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. If an entry is incomplete or if the Participant uses robotic, automatic, programmed, or similar methods, an entry will be disqualified. The authorized subscriber of the email account used to enter the Promotion at the actual time of the entry will be deemed to be the Participant and must comply with the rules set herein in the event of a dispute as to entries submitted by multiple users having the same email account. The authorized account subscriber is the natural person who is assigned an email address by an internet access provider, online service provider, or other organization responsible for assigning email addresses for the domains associated with the submitted email address.
Please note that, if the Participant requests a refund within thirty (30) days of the purchase of the Plan as per the General Terms of Service, the Gift will be canceled as well to prevent misuse. This means that the Gift will be invalidated, resulting in the loss of access to and/or use of the NordPass Premium Plan.
8. Miscellaneous.
By participating in this Promotion, each Participant agrees that Nord’s decisions related to the Promotion and all distribution of Gifts are final. Any difficulties in interpreting these rules and any disputes will be settled by Nord or by the competent courts.
9. Governing Law and Contact Information.
These Terms and Conditions will be governed by the law of Panama. Notwithstanding the foregoing, in compliance with the Electronic Commerce Directive (2000/31/EC) the accurate laws of the Participant’s country of residence will apply for consumers’ protection purposes.

Terms & Conditions of the NordPass Business Discount for Business 1Y & 2Y Plans

These are the terms and conditions of the NordPass Business discount for business 1y & 2y plans provided by Nord Security Inc., business address Americas Towers, 1177 6th Avenue, 5th FLR, New York, NY 10036, United States of America (“we”, “our”, “us” or “Nord”) to the first purchase of the NordPass Business service subscription (“Discount”; “Discount Terms”). By using this Discount, you agree to these Discount Terms. NordPass Business services are governed by the NordPass Business Terms of Service (“Terms”). Discount Terms shall have precedence over the Terms only in relation to the applicability of the Discount.
1. What is the Discount?
Discount is 30% off the pricing of annual NordPass Business 1 and 2 years subscription plans.
Discount will be available from October 16, 2024, to December 16, 2024 (GMT +2), unless extended at the sole discretion of Nord (“Discount Period”).
2. Rules of the Discount.
DISCOUNT EXPIRES BY THE END OF THE INITIALLY PURCHASED SUBSCRIPTION TERM. UPON ANY SUBSCRIPTION RENEWAL, THE DEFAULT PRICING OF THAT PLAN TO THAT DAY WILL START TO APPLY.
Discounts are not cumulative.
3. Who is eligible to use the Discount?
Any organization that agrees to these Discount Terms and does not have an ongoing NordPass Business subscription is eligible to use the Discount.
4. How to use the Discount?
During the Discount Period, Discount will automatically apply when purchasing NordPass Business subscription through self-checkout; or through NordPass Business sales team.
Nord does not guarantee, undertake, warrant, or represent that any discount code will remain available, active, or unchanged for any specific period of time. Different promotional campaigns may offer varying discount codes. Please note the exact discount that is applied by the code you use. Different terms and conditions may apply to each discount offered by Nord.
5. General conditions.
Nord may revise, modify, extend, or cancel these Discount Terms and/or the Discount without any reason or liability. The most recent version will be posted on https://nordpass.com/business-partner-discount-terms-conditions/. Revised Discount Terms, if not stated otherwise, will become effective from the day they are updated.
If not explicitly provided by Nord otherwise, these Discount Terms shall have prejudice before all the other marketing materials and otherwise provided information regarding the Discount.
Organizations hold the sole responsibility to ensure their own Internet access and technical systems’ proper functioning to use the Discount. Nord shall not have the obligation to review eligibility in case any Organization was for any reason unable to use or request the demo or the Discount.

6. Limitation of liability
NEITHER NORD NOR ANY OF ITS PARENTS, SUBSIDIARIES OR AFFILIATES, NOR ANY OF THEIR EMPLOYEES, REPRESENTATIVES, OFFICERS OR DIRECTORS, SHALL BE LIABLE TO ANY PARTY FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR OTHER DAMAGES ARISING OUT OF OR IN ANY WAY RELATED TO THESE DISCOUNT TERMS OR DISCOUNT DESCRIBED HEREIN, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAWS, IN ANY CASE, THE LIABILITY OF NORD SHALL NOT EXCEED 50 DOLLARS AND SHALL NOT INCLUDE ATTORNEY FEES OR COURT COSTS.
7. Disputes
The parties shall endeavor in good faith to resolve any dispute, claim, controversy, or disagreement relating to or arising out of these Discount Terms, or the subject matter of these Discount Terms (“Dispute”), by negotiation. Any Dispute that remains unresolved for 30 (thirty) days after either party gives written notice of the existence of such Dispute may be referred for final resolution by the competent courts of England in London, United Kingdom. The proceedings shall be held in English. The parties agree that these Discount Terms will be governed by the laws of England.
Where permitted under the applicable law, class action lawsuits, class-wide arbitrations, private attorney-general actions, and any other proceeding where someone acts in such a representative capacity are not allowed. Unless both parties agree, no arbitrator or judge may consolidate more than one Organization’s claims or otherwise preside over any form of a representative or class proceeding.
